The quhilk day, Johnne Cunynghame of Cunynghameheid younger, Thomas Levingstoun of Hanyng and Johnne Cleland of Foskane, ar becum cautionaris and souerteis, conjunctlie and severalie, that all and sindry, the cornis cattell and gudis being upoun the landis of Baddinhaith steilbow and utheris, or upoun ony stedingis of the saidis landis salbe furthcumand to the King and Quenis Majesteis, as accordis of the law, in caise it be fund that the samyn of law and ressoun pertenis to thair Majesteis as escheit; and that according to the inventour to be maid thairof be Alexander McCulloch, messinger, quha is presentlie direct be the Thesaurare to that effect, swa that the samyn gudis be nocht intromettit with be the Erle of Levenax, Lientenent, or be grittar force nor the saidis cautionaris ar abill to resist; and the saidis personis findand uthers als sufficient cautionaris betuix and the xv day of December instant, thai salbe relevit of this present Act. The quhilk day, Johnne Hammiltoun of Stanehous ( Lard of Stanehous), Sherefdepute of the sherefdome of Lanark, being callit in presens of my Lord Regentis Grace and Lordis of Secreit Counsall to answer and gif declaratioun upoun the diligence usit and done be him in sercheing, seking, taking, and apprehending of Gawin Cleland, Margaret Hammiltoun his moder, Cuthbert Craig, and James Wod in Gartschary, denunceit rebellis and put to the horne, be vertew of lettres in the four formes, past upoun ane decreit of the Lordis of Counsall and Sessioun, at the instance of Alexander Hume sone; lauchfull to Johnne Hume of Coldenknowis knycht, for non removing, desisting, and ceissing fra the landis and steding of Gartscharye, liand in the barony of Monkland, within the sherefdome of Lanark  It wes allegeit and answerit be the said Johnne Hammiltoun, Sherefdepute foirsaid, that he had usit exact diligence in sercheing and seking of the foirsaidis personis, rebellis, within the boundis of the said sherefdome as appertenis of his dewitie and office; and specialie that he had serchit, socht, and apprehendit the said Cuthbert Craig, ane of the rebellis foirsaidis, within the boundis abone writtin; and being apprehendit had him unto the place and castell of Hammiltoun, and thair deliverit him to Sir Johnne Johnnestoun, Chalmerlane and kepar thairof; to remane in sure keeping and firmance quhill he be ordourlie relaxt fra the said proces of horne; and swa wes ressavit and kepit in the said castell. And anent the charge gevin to Johne Hamiltoun, sumtyme of Stanehous, being for the tyme executing the office of Sherefdepute of the Sherifdome of Lanerk, to pas, serche, seik, and apprehend the foirsaidis personis complenit upoun, oure Soverane Lordis rebellis, and to bring and present them befoir my Lord Regentis Grace and Lordis of Secreit Counsale at ane certane day, to the effect thai nnycht have bene puneist, conforme to the lawis or this realme, under the pane of rebellioun and putting of the Sheref and his deputis to the horne; with certificatioun to him and he failyeit, letters sould be direct simpliciter to put thame to the horne, like as at mair lanth is contenit in the saidis letters, executioun and indorsatioun thairof. The saidis letters being callit, comperit the said Walter Chepman and Jonet Lindesay his spous; and the said Johne Hammiltoun being oftymes callit and not comperand, my Lord Regentis Grace and Lordis of Secreit Counsell, nderstanding that the said Johne Hammiltoun, sumtyme of Stanehouse, is presentlie under the a process of forfaltour for certane crymes of tressoun and lese majestie committit be him, of the quhilk he wes convict in Parliament. Thairfoir ordanis lettres to be direct charging and commanding James Duke of Chestellarault Erle of Arrane Lord Hammiltoun and Sheref Principall of Lanerk, presentlie being in ward within the Castell of Edinburgh, that he cause the office of Sherefschip of the said Sherefdome be usit and administrate be honest and qualifeit personis, that ar oure Soverane Lordis fre liegemen that ar nether foirfaltit nor denuncit rebellis and at the horne; and in speciall that he caus the saidis James Hammiltoun of the Tonngis, Gawin Cleland, Johne Hammiltoun and Walter Hammiltoun, sones to the said James, and James Chepman, oure Soverane Lordis rebell and at the horne, be serchit, socht, takin, apprehendit, and presentit befoir my Lord Regentis Grace and Lordis of Secreit Counsell at Edinburgh, or quhair it sal happin thame to be for the tyme upoun the xx day of December nix to cum, to the effect thai may be puneist conforme to the lawis of this realme, as the said Duke of Chestellarauld, Sheref Principall foirsaid, will answer to our Soverane Lord upoun his dewetye and obedience; certefeing him gif he failyeis heirin, my Lord Regentis Grace, with avise of the saidis Lordis of Secreit Counsell, in our Soverane Lordis name, will inhibit all oure Soverane Lordis liegis, inhabitantis of the said Sherefdome of Lanerk, that nane of thame sail answer nor obey in the Sheref Courtis of the said sherefdome, that sal happin to be haldin be personis foirfaltit or at the horne; and attour, command and commissioun salbe gevin and grantit to utheris, to convocate oure Soverane Lordis liegis, and to serche, seik, apprehend and persew the saidis personis rebellis as inymeis to oure Soverane Lord and this commounweill quhill thai be apprehendit and brocht to obedience.

April 6th Stirling Castle.

Complaint by Johnne Cranstoun, son of Johnne Cranstoun of Morestoun; and by George Hume of Weddirburne and Alexander Hume of Hutounhall, his curators, as follows: – The said Johnne Cranstoun, by gift of the King during Mortoun’s regency, has “the ward and nonentres of all and haill the aucht husband landis of Rymmiltounlaw, with thair pertientis, pertening to his Hienes, be ressoun of ward, throw deceis of umquhile George, Erll of Huntlie, lyand within the barony of West Gordoun and sherefdome of Beruik.” Accordingly, Cranstoun and his servants “hes bene in peciabill and continewall possessioun of the saidis landis, be lauboring, teilling, sawing, and manuring of the same, setting and disponing thairupoun at his plesour, without all stop, trubill, or molestation”. Nevertheless, Williame Hume, younger, brother german to James Hume of Coldin­knowis, Patrik Brounlie, Robert Dun in Hume, servants to the said Williame, George Hume in Kelso, Cristell Hume in Fallinesche, and Johnne Hume, his brother, there, “be thameselffis, thair servandis, and complices in thair names, of thair causing, command, assistence, ratihabitioun, upoun the sevint and ancht dayis of Marche last bipast, come to the said Johnnis pleuch, beand for the tyme yokit and gangand upoun the ground and landis of Rymmiltounlaw foirsaidis, and thair mannassit and boistit Patrik Greif, his servand and hynd, and compellit and constraynit him to lowis the pleuch, and leif the labouring of the ground, declairand to him in plane wordis that, gif evir he yokit the pleuch agane upoun that ground, or utherwayis war found lauboring the same, it sould coist him his life.”  The said hind, thus threatened, had then “lowsit the said pleuch, and as yit he nor na uther dar yok hir agane; quhairthrow the saidis landis lyis waist and unlabourit, to the said Johnnis extreme hurt, and to the greit contempt of our Soverane Lord and his authoritie” The parties accused had been duly summoned, under pain of horning, to appear before the Council on the 5th of April instant, to answer the complaint; and the decision now runs thus :-” Quhilkis being callit, and the said Johnne Cranstoun and his saidis curatouris compeirand be Thomas Cranstoun, his fader broder, and Andro Kneland, his procuratouris, and the saidis Williame Hume, younger Patrick Brounlie, Robert Dun, George Hume, Cristell Hume and Johnne Hume, beand oftymes callit, and not compeirand,” these last six are to be put to the horn and to escheat.
